1. Object
These Terms and Conditions of Use (TCU) aim to define the modalities and conditions under which MT Cash (hereinafter 'the Issuer') makes its mobile payment and electronic money services available to its users.
2. Definitions
• MT Cash Account: Electronic money account opened in the User's name.
• User: Any natural or legal person who has subscribed to the service.
• Transaction: Any debit or credit operation performed on the Account.
3. Adhesion to the TCU
The use of MT Cash services implies the full and entire acceptance of these TCU by the user. Adhesion is formalized during account opening via the mobile application or at an agency.
4. Account Opening
Opening an account is free. The user must provide a valid ID (CIN) and an active mobile phone number. The Issuer reserves the right to refuse any account opening without having to justify the reason.
5. Use of Services
The User can perform the following operations:
• Cash deposit and withdrawal.
• Account-to-account money transfer.
• Bill payment and phone top-ups.
• Payment at merchants accepting MT Cash.
6. Security and Confidentiality
The user is solely responsible for the preservation and confidentiality of their PIN code. Any operation validated by the PIN code is deemed to emanate from the User. In case of loss or theft of the phone, the User must immediately contact customer service to block the account.
7. Rates and Fees
Service rates can be consulted on the mobile application and at authorized points of sale. The Issuer reserves the right to modify the rates, subject to informing the User 30 days in advance.
8. Data Protection (Law 09-08)
MT Cash commits to protecting personal data. The information collected is necessary for service management and may be communicated to competent authorities within the framework of current regulations.
9. Termination
The User can terminate their account at any time without fees, subject to a zero balance. The Issuer may suspend or close an account in case of fraudulent use or non-compliance with these TCU.
10. Applicable Law and Disputes
These TCU are subject to Moroccan law. In case of dispute and failing an amicable agreement, exclusive competence is attributed to the commercial courts of the Kingdom.
